2006 Suzuki King Quad 700 Brake issue

So my dad had never been on a 4 wheeler and I convinced him to go for a ride. He was on the Suzuki and I was on my Blaster. We went probably 5 miles and when we stopped I noticed oil coming out of the vent tube for the rear end. I tried to open the dipstick on it to check it and burned my fingers on the dipstick. I used a glove and opened it and smoke came out I could smell burnt oil. I think he was riding the foot brake pedal. He has no prior experience on quads so probably didn't realize the lack of power from riding the brakes.

My question is What do I have to do to fix it? Drain oil and refill? Major repair on brakes? I know it is hard to diagnose from the interweb with no pics but without taking it apart there is really nothing to take a pic of. Ideas where to start.
 
change the rear end fluid, it's prolly long overdue for a change anyway
and inspect brake pads/shoes, if worn, replace
